    1. BORDER SECURITY

    Record Number of Illegal Aliens Crossing the Border

    • Secretary Mayorkas has encouraged the flow of illegal aliens over the border and has the numbers to show for it. In FY23, there were over 3.2 million encounters at our borders. From FY21-FY23, Mayorkas touts over 8 million encounters of illegal aliens at U.S. borders, along with at least 1.7 million “gotaways.” The increased flow over our borders has created a crisis – affecting communities, law enforcement and families across the country, and burdening Americans with higher fiscal and human costs.[1]
    • In the month of December alone, CBP saw a record 370,899 encounters nationwide, with 301,982 of those encounters being at the southern border. On December 5, 2023, sources also reported 12,080 aliens attempting to illegally cross into the U.S., showing a trend of dramatically increased crossings on Mayorkas’ watch. [2]

    Border Wall Deconstruction

    • Rather than continuing construction on the border wall, and protecting Americans from illegal drugs, crime, and smuggling that comes across the southern border, the Biden Administration and Secretary Mayorkas have done nothing but make empty promises to border states.
    • In 2022, Mayorkas promised multiple heavily trafficked areas along the border, including Yuma, Arizona, that he would work to install barriers, and fix holes in Trump’s unfinished border wall. However, according to Yuma County Supervisor Jonathan Lines, it has been almost a year since that promise, and there has been little to no progress. Border states and interior states alike are reeling from the effects of illegal immigration as a result.[3]
    • To make matters worse, the Biden Administration and Secretary Mayorkas have begun selling unused parts of the border wall that could be used to secure border cities like Yuma. The Administration has sold 81 lots of steel “square structural tubes” intended to be used for border wall panels, 729 hollow beams, with several more lots scheduled to be sold. The sales have brought in a little over $2 million, hardly making a dent in the cost incurred through open border policies.[4]
    • Since Mayorkas took over, up to $300 million worth of border wall parts, paid for by taxpayers, have been left unused.[5]

    Remain in Mexico

    • On October 29, 2021, Secretary Mayorkas announced his decision to terminate the Migrant Protection Protocols (MPP) program.[6]
    • MPP was created under President Trump, and required migrants to wait in Mexico while awaiting their asylum hearings. MPP took important steps towards decreasing asylum abuse and illegal border crossings. The termination of MPP was part of a slew of open border policies that encouraged lawlessness and asylum abuse, and made it much more difficult to prioritize asylum seekers with legitimate claims.

    CBP One

    • In an effort to cover the volume of illegal aliens crossing into the United States, new programs such as the CBP One mobile application are being used as a concierge service to speed up the entry of aliens. The app was originally being used to process 1,250 appointments a day, with more than 49,000 aliens scheduling appointments from May to the end of June, 2023. On June 30, 2023, DHS announced that it would increase daily appointments to 1,450.[7]
    • DHS claims the app is being used to admit on a case-by-case basis, and that CBP One’s technology “reduces the potential for smugglers or others to exploit migrants.”[9]
    • However, cartels have begun to exploit CBP One’s security technology, selling aliens a VPN signal that scrambles the app’s location services, rendering it unable to tell whether the person making an appointment is inside the Central Mexico geofence. As a result, the CBP One app is offering cartels more ability to conduct moneymaking schemes and control the border.[10]

    • On January 6, 2023, the Biden Administration abused its parole authority under INA 212 (d)(5) of the Immigration Nationality Act to create a new parole program for nationals of Cuba, Haiti, Nicaragua, and Venezuela.[11]
    • Through the end of July 2023, over 181,000 Cubans, Haitians, Nicaraguans, and Venezuelans arrived via the CHNV Parole Processes. That number includes more than 41,000 Cubans, more than 72,000 Haitians, more than 34,000 Nicaraguans, and more than 63,000 Venezuelans who have been authorized for travel.[12]
    • On April 27, 2023, the Biden Administration further abused its parole authority by creating a new family reunification parole process, which grants parole to entire categories of aliens rather than granting parole on a case-by-case basis, as required under 212 (d)(5).[13]
    • In November 2021, the Administration formally created an Alternatives to Detention (ATD) plus parole program to release hundreds of thousands of aliens after they were encountered at the border—until it was enjoined by a federal court in March 2023 for violating the parole statute.  In FY22 alone, Border Patrol released over 338,000 aliens using the program.[14]

    • On May 3, 2023, the DHS Office of the Inspector General released a report titled, “Intensifying Conditions at the Southwest Border Are Negatively Impacting CBP and ICE Employees’ Health and Morale.”[15]
    • The scathing report notes the increased workload on ICE and CBP personnel as a result of increased border encounters, and worsening conditions at the border. Despite the challenges faced by ICE and CBP employees during the border crisis, staffing levels have largely remained the same, leaving staff overworked and unable to perform their duties effectively. The report also notes that the low morale of ICE and CBP staff could lead to faster turnover, and earlier retirements, which would make the problem even worse.

    2. INTERIOR ENFORCEMENT

    Sanctuary Cities

    • In April 2021, Secretary Mayorkas stated that he was determined to stand up to sanctuary cities that did not cooperate with ICE. However, his actions as Acting Secretary show nothing but encouragement for sanctuary cities to continue disobeying federal law.[16]
    • As of 2023, there are 300 sanctuary jurisdictions in the United States under Mayorkas’ watch.[17]
    • In 2021, nearly $300 million was awarded to sanctuary jurisdictions from three federal law enforcement related grants (the State Criminal Alien Assistance Program, Edward M. Byrne Justice Assistance Grant, and Community Oriented Policing Services). Of the $1.4 billion available to these grant programs, 43% went towards sanctuary jurisdictions. SCAAP alone awarded 58% of its total towards sanctuary cities, a dramatic increase from 2010 when SCAAP awarded 16% of its total to sanctuary jurisdictions.[18]
    • Due to the border crisis, so-called sanctuary jurisdictions are beginning to crack under the pressure to house the thousands of aliens arriving at their doorsteps. New York City Mayor Eric Adams has begun to urge the White House to declare a state of emergency to help New York deal with the “humanitarian crisis” resulting from the surge of illegal aliens. New York City alone has taken in nearly 120,000 aliens and does not have shelter space to account for all of them.[19] In fact, New York City is trying to expel aliens from the city by putting up new posters urging them to consider other cities.[20] This just goes to show that even sanctuary city jurisdictions are feeling the impacts of the border crisis.

    Mass Release of Illegal Aliens, Including Criminals

    • INA Section 235(b) requires that inadmissible aliens, whether subject to expedited removal or regular removal proceedings, be detained. This includes asylum seekers.  Further, Section 236(c) of the INA requires the government to detain inadmissible aliens who have committed criminal offenses or who are inadmissible on terrorism grounds.
    • Despite federal law, under Secretary Mayorkas very few of the migrants who were encountered at our borders over the last three years were detained. Rather, under the policies of Secretary Mayorkas, they were processed and released into the country. Secretary Mayorkas himself admitted that over 85 percent of migrants encountered at the southern border have been released into the U.S.[21]
    • The Department of Homeland Security’s detention statistics confirm this mass release policy. In 2023, the average number of aliens detained on a daily basis was just 28,289. In FY 2022, the average daily population was 22,578, are far below the number of detention beds ICE maintains: 34,000. Moreover, the Biden Administration has proposed cutting detention beds to 25,000 in the FY24 budget. It also proposed cutting beds in FY 2023.
    • Mayorkas’ mass release policy has let criminals roam free in the United States.  According to data obtained by the House Judiciary Committee in January 2024, there are at least 617,607  aliens with criminal convictions or pending charges on the non-detained docket (awaiting court proceedings).[22]
    • Ultimately, it is clear that Secretary Mayorkas is attempting to eliminate detention altogether and instead rely on “Alternatives to Detention” (ATD) to allow illegal aliens to freely move about the United States. Since taking office, he has dramatically expanded ATD programs that rely less on electronic monitoring and focus more on providing social services and other taxpayer funded benefits. Yet, there is no data to show that illegal aliens are complying with court orders upon receiving taxpayer-funded benefits.
    • In August 2021, as part of Secretary Mayorkas’ expansion of ATD, DHS announced the Case Management Pilot Program (CMPP), a new pilot program that grants nonprofit organizations and local governments money to provide aliens with mental health services; human and sex trafficking screening; legal orientation programs; cultural orientation programs; and connections to social services.[23]
    • In August 2023, Secretary Mayorkas proposed rebranding the ATD program to call it Release and Reporting Management (RRM), which uses taxpayer dollars to fund community services for illegal migrants.[24]
    • These actions, done at the behest of open-borders advocates, are an attempt to transform ICE to an agency that aids those who violate our immigration laws, rather than upholding those laws. If Congress allows Secretary Mayorkas to continue on this path, ICE will no longer serve as a law enforcement agency. It’s like asking the Drug Enforcement Administration (DEA) or the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to start providing therapy to criminals.

    Non-Enforcement

    • On September 30, 2021, Secretary Mayorkas issued a memorandum titled “Guidelines for the Enforcement of Civil Immigration Law,” which stated that an alien’s legal status in the United States should not be the sole basis of an enforcement action.[25]
    • On October 27, 2021, Secretary Mayorkas issued a memorandum titled “Guidelines for Enforcement Actions Near Protected Areas,” which listed numerous protected areas where the enforcement of federal immigration law should not occur.[26]
    • Despite the record number of illegal aliens crossing the border, deportations and detention have dropped sharply.
    • In FY23, the average daily population detained by ICE was 28,289. This is far below the congressional directive of detaining 34,000 aliens on average each day.
    • ICE is responsible for removing these illegal aliens, especially when they are ordered removed by an immigration judge. At the end of FY23, over 1.08 million illegal aliens with final orders of removal were still residing in the United States. The non-detained docket (those awaiting their court dates) increased from 3.262 million in FY2020 to 6.199 million at the end of FY23. The Biden Administration has a dismal record when it comes to removals – only effectuating about 91,000 on average each year over the last three years.
    • In FY21 and 22, the number of illegal aliens removed declined by roughly 70 percent — not even keeping up with the hundreds of thousands of known criminal illegal aliens — and more than 11,000 detention spaces were consistently left empty.[27]

    3. DISREGARD FOR RULE OF LAW AND FISCAL MISMANAGEMENT

    Public Charge

    • Under the Trump Administration, DHS issued a public charge rule that required immigrants seeking to enter the United States or adjust to permanent status to be self-sufficient, and established clear standards of dependency that would classify an individual as a public charge. However, under Biden and Secretary Mayorkas, a new regulation moved to lessen public charge restrictions, and undermine the intent of the law. The new regulation only allows consideration of cash benefits and long-term institutionalization, and doesn’t consider Medicaid, Supplemental Nutrition Assistance Program (SNAP), and various housing vouchers. Under Secretary Mayorkas, American families are being put last, while illegal aliens use up taxpayer funded benefits.

    • On November 11, 2022, DHS released a final rule to preserve and fortify Deferred Action for Childhood Arrivals (DACA). The rule’s implementation sought to make DACA a formal regulation, despite it being the subject of litigation, and the U.S. Court of Appeals for the Fifth Circuit ruling DACA unlawful in October 2022. The rule nonetheless declared DACA recipients as “lawfully present,” and provided them the ability to obtain employment authorizations.[28]

    • On April 13, 2023, the Biden Administration announced that participants in the Deferred Action for Childhood Arrivals (DACA) program would be able to apply for health care coverage under the Affordable Care Act, and some Medicaid programs. This announcement runs counter to immigration laws and will increase the fiscal burden on American taxpayers.[29]

    Providing Taxpayer Funding for NGOs to Aid and Abet Illegal Aliens

    • On March 28, 2023, the DHS Inspector General released a report following its audit of funds awarded under the American Rescue Plan Act. The Act was signed into law in March 2021, and hidden inside was a $110 million appropriation to FEMA’s Emergency Food and Shelter Program (EFSP). EFSP would award this funding to nonprofits to provide food, shelter, and services to illegal aliens encountered at the southern border.[30]
    • The report found that a portion of the grant recipients violated the terms of the program, failing to provide receipts for reimbursements, failing to maintain logs of individuals served, or providing services for individuals who didn’t have DHS records. Out of the audit’s $12.9 million sample, OIG was unable to account for $7.4 million. If the same pattern held for the entire batch of funding, FEMA would be unable to account for nearly $64 million of the sample.
    • In August, 2023, DHS announced another tranche of funding through FEMA’s Shelter and Services Program (SSP) for non-governmental organizations (NGOs) that assist illegal aliens at the border. The funding is geared towards helping NGOs provide food, shelter, clothing, and other services to aliens who have recently entered and are awaiting immigration proceedings. The second tranche, allocating $77 million to 53 recipients, with El Paso County and Catholic Charities of San Diego receiving the highest amount, builds on the first tranche released in June when DHS doled out $291 million through SSP. In June, the New York Office of Management and Budget received over $104 million of the funding.[31]

    Fiscal Burden

    • The estimated fiscal burden due to illegal immigration on taxpayers is $150.7 billion annually, which is a huge spike from FY17 when the fiscal burden was approximately $116 billion.[32]
    • Tax payments by illegal aliens cover only roughly one sixth of the costs incurred by government entities in the United States on their behalf.
    • During FY22, federal justice enforcement expenditures because of illegal immigration were $25.1 billion and total federal welfare program expenditures for illegal aliens were $11.6 billion.
    • Due to the open border agenda encouraged by Secretary Mayorkas, taxpayers are paying almost $35 billion more to provide for illegal aliens. With record numbers of border crossers in FY23 YTD, this fiscal burden will continue to get worse without effective policy changes.

    4. CARTELS AND SMUGGLING

    Drug Trafficking

    • With relaxed enforcement, Secretary Mayorkas is allowing drug trafficking to increase and leaving communities alone to deal with the effects.
    • In FY23 (to date), fentanyl seizures are at record highs, with more than 25,600 pounds seized, already more than five times the FY20 total.[33]
    • In San Diego County alone, fentanyl-related overdose deaths have risen 2,375 percent, showing the detrimental impact that increased drug trafficking has on American communities.[34]
    • As noted in a recent House Homeland Security Committee hearing, more than 1,500 people per week die from taking some form of opioids, representing an all-time high.[35]
    • In FY21, there were over 70,600 fentanyl-related overdose deaths in the United States, compared to around 40,000 in FY19.[36] In addition, pediatric deaths from fentanyl were 30 times higher in 2021 than they were in 2013 nationwide.[37]

    Cartels and Human Trafficking

    • Mayorkas’ refusal to enforce our immigration laws and secure our borders has given the drug cartels and other criminal organizations free reign to smuggle in illegal aliens and drugs. His policies have helped the cartels grow stronger, fueled the humanitarian crisis at the border, and allowed fentanyl drug deaths among Americans to skyrocket. 
    • Mexican cartels are receiving an estimated $13 billion each year from human trafficking operations across the southern border of the United States. That represents a massive increase from around $500,000 in profit for cartels from human trafficking in 2018.[38]

    Unaccompanied Alien Children

    • In 2014, Vice President Biden stated that between 75 and 80 percent of unaccompanied children were brought into the United States by smugglers, many that “routinely engage in physical and sexual abuse, and extortion.”.[39]
    • Under Mayorkas, in FY22 the number of unaccompanied alien children encountered attempting to enter the country soared to 150,000 in each year, more than four times the total from FY20.[40]
    • On March 5, 2023, Mexican police rescued 343 people crammed into an abandoned semi-truck on the Cosamaloapan- LaTinaja highway. Of those rescued, 103 were unaccompanied children.[41] In June 2022, over 51 aliens died trapped in an abandoned trailer in San Antonio, Texas.[42]
    • According to a Florida Grand Jury Report, unaccompanied alien children are not DNA tested at the border to see “if, in fact, they might be an adult with a criminal history or if they are truly biologically related to either their putative parent or a proposed sponsor.” Lack of DNA testing at the border contributes to child recycling, sex trafficking, and labor trafficking of vulnerable children. Mayorkas’ failure to implement stronger vetting processes through DNA testing at the border has put thousands of UACs in harm’s way.[43]

    • Over the past two years, HHS and DHS have lost track of 85,000 UACs. The NYT report led to several members of Congress demanding an FBI investigation into HHS and DHS for their role in the UAC disappearance.[44] It is highly likely that many of these children were trafficked for cheap labor, sex, and other exploitative reasons. Without sound policies at the border, Mayorkas has rendered DHS unable to ensure the safety and security of vulnerable minors.

    5. CRIMINAL ALIENS

    • Despite what the law says, Mayorkas’ DHS is not detaining criminal aliens and instead, is allowing them to be released into the interior while they wait years for their court date.
    • As of March 2023, an estimated 5,290,000 illegal aliens were on ICE’s non-detained docket, including 407,983 criminal aliens. However, even with the high number of illegal aliens present, Secretary Mayorkas’ DHS asked for less funding towards its detention efforts, and overall arrests are down 69% since FY18.[45]

    • FY22 saw record highs in arrests of aliens convicted for illegal drug possession and trafficking (2,239), along with over 1,100 arrests of aliens convicted of assault, battery, or domestic violence, 365 arrests for sexual offenses, and 309 arrests for illegal weapons possession, transport and trafficking.[46]

    6. NATIONAL SECURITY

    • In a July Homeland Security Subcommittee on Border Security and Enforcement hearing, Chairman Pfluger noted that Border Patrol has already encountered 140 aliens on the Terrorist Watchlist between ports of entry on the southern border this fiscal year.[47] That number now stands at 151.[48]
    • In August 2023, it was reported that foreign nationals were helped into the United States by a human smuggler with ties to ISIS. Many of those aliens remain unaccounted for and present potential national security risks.[49]

    Suspected Terrorist Released into U.S. under Mayorkas’ Watch

    • On June 28, 2023, The DHS Office of the Inspector General released a report titled, “CBP Released a Migrant on a Terrorist Watchlist, and ICE Faced Information Sharing Challenges Planning and Conducting the Arrest.”[50]
    • This report details CBP’s ineffective practices in resolving inconclusive matches with the FBI’s Terrorist Watchlist. The Yuma, AZ sector, which encountered the alien, said it had received a high number of aliens on the day the migrant was released. Once released, the alien traveled on an airplane across the country from Arizona to Tampa after being flagged by TSA as a confirmed match. ICE later faced challenges in arresting the alien due to a lack of information sharing. As a result, the alien was not detained for nearly a month after his faulty release into the United States.

    7. HARMING AMERICAN WORKERS

    Expanding Visa Programs That Harm American Workers

    • On October 12, 2022, DHS announced that it would issue a regulation that would make 64,716 additional H-2B visas available to employers of nonagricultural workers for FY23. This supplement was added on top of the 66,000 H-2B cap, and without added protections for American workers.[51]

    Displacing U.S. Workers

    • According to a May 18, 2023 report on labor force characteristics by the Bureau of Labor Statistics (BLS), foreign-born workers accounted for 18.1 percent of the U.S. labor force in 2022.
      • 2022 was a record-breaking year for foreign-born workers, their participation was the most in 27 years.
      • Foreign-born men continued to participate in the labor force at a considerably higher rate in 2022 (77.4 percent) than their native-born counterparts (66.0 percent).
    • According to BLS statistics, over 1.2 million native-born Americans lost jobs from July to August 2023. However, over the same period, nearly 700,000 new jobs went to foreign-born workers and boosted foreign-born employment to a record high.
    • The federal government currently has a caseload of 1.5 MILLION pending applications for work authorization.  Many, if not most of those, will be from illegal aliens eligible for work authorization through the Biden Administration’s outrageous and damaging immigration policies.

    • On October 12, 2021, Secretary Mayorkas issued a memorandum titled “Worksite Enforcement: The Strategy to Protect the American Labor Market, the Conditions of the American Worksite, and the Dignity of the Individual,” which created Department-wide guidance to cease mass worksite enforcement operations.[52]
