Employment Eligibility Verication Pilot Program

Immigration, Border Security and Claims Subcommittee (Chairman Hostettler, R-Ind.) of House Judiciary Committee will mark up legislation that would extend the employment eligibility verification pilot program. The program is a free service available to any employer who wishes to participate, offered by the Immigration and Naturalization Service and the Social Security Administration that confirms employment eligibility of immigrants via an electronic search of Social Security numbers and alien registration numbers. The program was created by section 401(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 and was originally set to expire in November 2001. It was extended for two years and now is scheduled to expire in January 2004.

A social security totalization agreement is an executive agreement entered into by the United States with various foreign countries. The purpose of a social security totalization agreement is to: relieve the employer and employee from double social security tax with respect to the same employment and to "totalize" the employee's Social Security tax paid to both countries in order to receive the combined benefits in only one country. A totalization agreement does not permit an employee to avoid Social Security tax in both countries; rather, it merely allows the employee to pay tax to either one country or the other.

Immigration, Border Security and Claims Subcommittee (Chairman Hostettler, R-Ind.) of House Judiciary Committee held an oversight hearing on Title V of HR 3526 (PL 107-173), which direct the attorney general to develop an electronic means of verifying and monitoring the foreign student and exchange visitor information program, including aspects of: (1) documentation and visa issuance; (2) U.S. admission; (3) institution notification; (4) documentation transmittal; and (5) registration and enrollment. The act requires an institution to notify INS of the failure of a foreign student or exchange visitor to enroll within 30 days of the registration deadline, increases student data collection requirements and specifies information required for foreign student visa applications. The hearing will focus on ways the law could be made to function more smoothly and effectively.
