As we approach the 100-day mark of the Biden administration, let’s imagine the unthinkable for a moment.
As hundreds of thousands of illegal aliens pour through our borders, we have a president who by his actions encourages it.
Not only has the rule of law collapsed, but the crisis has the potential to completely alter the nation’s prospects, from the sustainability of the American middle class to the sustainability of the American environment.
President Biden is breaching his fundamental responsibility to control the borders of the United States. He refuses to enforce the law in the interior, at the border, or permit cooperation between states and the federal government. He encourages illegal immigration by incentivizing it at every level. He is expanding non-immigrant visa programs and encouraging the replacement of American workers with “temporary” foreign workers.
Rather than address any element of the ongoing Biden border crisis, House Democrats spent their time moving legislation that only worsens the already grave situation at our southern border. The NO BAN Act jeopardizes our national security and public health, while the Access to Counsel Act further overwhelms our immigration courts and creates unnecessary burdens to already strained immigration authorities. Passage of both bills reveal how detached House Democrats are from properly addressing the nation’s most pressing immigration matters.
As the Biden campaign ratcheted-up its rhetoric leading to the 2020 election – decrying not another mile of wall would be built – I, as the former acting commissioner of U.S. Customs and Border Protection (CBP) and chief of the U.S. Border Patrol, knew they were playing a dangerous game of politics. From an operational perspective I knew the cost and how it would jeopardize our border security.
In March, as the impact of President Joe Biden’s open borders policies turned a border problem into a full-blown border crisis, the president handed his second-in-command the task of trying to convince the American public that the administration sincerely wanted to fix the mess he created.
Last week, the Biden administration announced that it would extend the Title 42 public health order. Title 42 allows immigration authorities to quickly remove illegal aliens from the country to help prevent the spread of COVID-19 in processing facilities and within American communities. The extension reveals that the administration views the order as effective and should rightfully keep it in place as apprehension totals remain at historic levels and COVID-19 variants continue to proliferate.

The incoherence is breathtaking, even for some members of the president’s own party. Rep. Henry Cuellar, D-Laredo, is urging the White House to stop releasing thousands of illegal aliens, many of them unvaccinated and untested for coronavirus, into the country’s interior.

A video showing an altercation between Border Patrol agents and Department of Homeland Security (DHS) leadership in Laredo, Texas, is making rounds on social media. The interaction was seen as unprecedented, and the optics were disastrous for DHS Secretary Alejandro Mayorkas and Border Patrol Chief Raul Ortiz. This video, however, is just the tip of the iceberg. Spats among frontline workers and Biden’s DHS leadership are a widespread, recurring pattern with no end in sight.
The latest video from Laredo reveals a major problem: The employees of the nation’s largest federal law enforcement agency do not have faith in its leaders.
This bill, while well-intentioned, falls short of doing anything to counter Chinese aggression. Even worse, it contains immigration provisions that raise serious economic and national security concerns, effectively undercutting any positive aspects of the legislation.
