Section 1: Title
Section 2: Reporting of Information on Arrestees
This section forces Immigration and Customs Enforcement (ICE) to publicize illegal alien crime data for state and local crimes.
- The Director of ICE must publish (online) an annual report listing certain information about each person who either: 1) has been the subject of a request submitted by ICE’s Law Enforcement Support Center or 2) who has been flagged as an alien through the program (formerly known as Secure Communities) by which local law enforcement submit the fingerprints of individuals into the databases of the Department of Homeland Security and the Department of Justice.
- The information that must be published includes: immigration status, nationality, and offense for which the person was arrested.
Section 3: Reporting By FBI Director
This Section requires the federal government to publish illegal alien crime data in the Federal Bureau of Investigation (FBI)’s annual crime reports. It requires that:
- The Director of the FBI must include the illegal alien crime data listed in Section 2 in its Uniform Crime Reports, which is the report that compiles nationwide criminal statistics each year.
